Luigi Mangione’s New York murder trial adjourned until December over double jeopardy concerns

Luigi Mangione’s New York state murder trial has been adjourned until December following his defense team’s motion to dismiss the charges in the wake of last week’s guilty plea on related federal charges.

Jury selection had been penciled in to begin on Sept. 8 — but the guilty plea allowed his defense team to raise new double jeopardy concerns.

Prosecutors have until Oct. 9 to respond to the motion to dismiss, Judge Gregory Carro wrote in an order published to the court’s website Monday afternoon.

Then the defense will have until Oct. 30 for Mangione’s own reply.

Carro set the next adjourned date for Dec. 10.

Due to a difference in state law and the U.S. Constitution, New York’s double jeopardy rules are more favorable to Mangione with the federal case resolved.

Manhattan prosecutors, however, have said they plan to continue pursuing their case against him.

Thompson was a 50-year-old father of two from Minnesota.

Mangione has not yet been sentenced in the federal case. Sentencing guidelines recommend about 30 years max, but Judge Margaret Garnett is not bound by them. He could still face a maximum of life in prison without parole.
