A juror at Lindsay Clancy’s triple murder trial revealed the surprising initial split of the panel when they first started deliberations and the moment a male holdout juror’s alleged doubt sank in.
Juror Paula Devlin told Gayle King on “CBS Mornings” that when the group first began the decision-making process “eight people were leaning toward not responsible, two hadn’t decided and two thought guilty.”
Devlin said eventually the split shifted toward 10 for Clancy being found not criminally responsible and two for her guilt.
“I felt very bad for them because they felt really attacked and there is no way to not do that because that’s where we were talking,” Devlin said. “Even in normal conversation when it’s pointed at you and you have to defend yourself, it’s a hard thing to do.”
In the end, the sole holdout juror – who Devlin identified as a black man in his 30s – started to show his doubt of Clancy’s guilt when he watched a video interview the killer mom gave, the juror claimed.
“And then we watched the video of Lindsay’s interview and after that [the holdout] said he had realized that it wasn’t murder in the first degree. That’s where we saw his doubt.”
On the sixth day of deliberations, the female foreperson sent a note out to Judge William Sullivan notifying him the holdout was allegedly refusing to follow the law on reasonable doubt.
After that note, the judge questioned each juror individually and eventually re-read them his instructions on the law.
Sullivan declared a mistrial the following day after roughly 38 hours of deliberations.
Clancy’s lawyer, Kevin Reddington, asked the jury to find the 36-year-old Duxbury, Massachusetts, mom not guilty by reason of insanity, claiming she was suffering from severe postpartum psychosis at the time she strangled Cora, 5, Dawson, 3, and Callan, 8 months.
